Overtime Hours & Breaks

Disability Insurance

Q. I have been employed for the last five years, but last weekend, while I was fixing the roof on my house, I fell off the ladder and broke my arms. The doctor tells me I will be out of work for at least six months. Is there a program that will provide me financial help while I am out of work?

A. Yes, the program State Disability Insurance is an employee funded program that provides benefits to an insured and qualified employee who suffers from loss of wages and cannot work because of illness or injury not related to the job, including illness or injury resulting from pregnancy or childbirth.

Overtime Hours & Breaks

In the state of California, any work over 8 hours a day must be compensated at a minimum, one and a half times the regular hourly wage.  Any work over 12 hours a day must be compensated at no less than twice the regular pay.

Any employee that worked over 5 hours a day will have a meal break of no less than 30 minutes.  A second break of 30 minutes must be giving if the work day is over 10 hours.

Useful Hint:
It is required for all employers to post in a convenient and easy to access area Labor Notices or Posters that list most up to date labor rights for employees.  Many employment questions can be answered there.
